FREQUENTLY ASKED QUESTIONS

what is mediation?

Mediation is a process where parties meet with a mediator (a neutral third party) to discuss their outstanding issues. It is the mediator's role to assist the parties in their discussion.

WHY USE MEDIATION?

A separation can be complicated, emotional and overwhelming. It can be difficult to see eye-to-eye with your spouse as you try to determine parenting time, child support, spousal support and divide your property. While some separating couples are able to come to resolutions on their own, others need the assistance of an unbiased third party mediator. Mediation is a great tool for people who do not want to put their future in the hands of a judge.

Are we court certified?

Crystal Robertson is a recognized family mediator as defined in the The King's Bench Act.

is mediation therapy?

Mediation is not therapy. The role of a mediator is to help the parties have discussions with each other with a goal of resolving an issue. We find solving problems makes us feel better, and we hope it does for you as well.

do I need a lawyer?

You are not required to have a lawyer when you attend mediation. However, we encourage each party to seek legal advice and speak to a lawyer so that they know their rights and obligations in the situation. We provide information on family law topics, but cannot provide you with any advice on what to offer or to accept.

can my lawyer attend our mediation sessions?

In most situations lawyers do not attend mediation sessions and it is not necessary for your lawyer to attend mediation with you. However, if you want your lawyer to attend, we will discuss that and make arrangements.

can I record my mediation session?

Privacy and confidentiality are two elements that are critical to the mediation process. With that in mind, we do not allow our clients to record our sessions. Your mediator will work with you to get you notes, summaries and whatever else you may need, to feel fully informed of where you are in the process.
